RELEASE OF LIABILITY, ASSUMPTION OF RISK & INDEMNITY AGREEMENT

Welcome to The Sim Box. We’re excited to have you and want your experience to be safe, enjoyable, and fun.

Please read this agreement carefully before using The Sim Box facilities. This is an important legal document that may affect your legal rights. By signing or electronically accepting this agreement, you acknowledge that you have read, understood, and agreed to its terms.

In consideration for being permitted to enter and use The Sim Box facilities, simulators, equipment, and services, I agree as follows:

1. ASSUMPTION OF RISK

I understand that indoor golf and golf simulator activities involve inherent and other risks. These risks may include, but are not limited to, being struck by a golf club or golf ball, slips, trips, falls, equipment malfunction, equipment failure, contact with walls or other objects, and the actions of other participants or guests.

I voluntarily choose to participate in activities at The Sim Box and knowingly assume the risks associated with using the facility and its equipment, including the possibility of personal injury, property damage, serious injury, or death.

As the individual making the reservation, I am responsible for ensuring that everyone in my group follows The Sim Box's safety and facility rules.

2. FACILITY & SAFETY RULES

I agree that I and my guests will follow all rules, safety instructions, posted notices, and policies established by The Sim Box.

Only one golfer may swing a club in the designated hitting area at a time. Everyone else must remain a safe distance away.

Reckless behavior, horseplay, throwing clubs, intentionally hitting balls outside the designated hitting area, or any other activity that could endanger people or property is prohibited.

I also agree to comply with all applicable alcohol laws and The Sim Box's alcohol policies.

Failure to follow facility rules may result in immediate termination of the reservation and removal from the facility without a refund.

3. RELEASE OF LIABILITY

To the fullest extent permitted by Michigan law, I release and hold harmless The Sim Box, its owners, affiliated entities, officers, employees, representatives, agents, contractors, and other authorized personnel (collectively, the "Released Parties") from claims arising from my participation in indoor golf activities or my use of the premises, simulators, or equipment, except where such a release is prohibited by applicable law.

I understand that this release is intended to cover claims involving personal injury, property damage, or other losses associated with the risks I have voluntarily assumed.

4. AGREEMENT REGARDING CLAIMS

To the fullest extent permitted by law, I agree not to bring a claim against the Released Parties for injuries, losses, or damages that I have expressly assumed or released under this Agreement.

I understand that this Agreement is intended to apply to me and, where legally permitted, my heirs, estate, personal representatives, and anyone making a claim on my behalf.

Nothing in this Agreement is intended to waive any right or claim that cannot legally be waived under Michigan law.

5. INDEMNIFICATION

To the fullest extent permitted by law, I agree to indemnify and hold harmless The Sim Box and the Released Parties from claims, losses, damages, expenses, or reasonable legal costs resulting from my negligent, reckless, intentional, or unauthorized actions while using the facility.

This includes claims or damages caused by my actions involving another guest, The Sim Box property, simulator equipment, or other property.

6. DAMAGE TO EQUIPMENT OR FACILITY

I understand that I am responsible for damage caused by me or my guests resulting from misuse, negligence, reckless behavior, intentional acts, or failure to follow The Sim Box rules.

This includes damage to simulator screens, launch monitors, projectors, computers, televisions, golf clubs, golf balls, furniture, walls, doors, flooring, security equipment, or any other property belonging to The Sim Box.

I understand that I may be responsible for reasonable repair or replacement costs resulting from such damage.

7. CLEANLINESS

I agree to leave my simulator suite, bay, and surrounding areas in reasonably clean condition.

If the area requires excessive cleaning after my reservation, The Sim Box may assess an additional cleaning charge.

8. RESERVATION TIMES & ADDITIONAL TIME

I understand that my reservation begins and ends at the times shown on my booking.

I agree to finish my session and leave the simulator bay promptly at the end of my reservation.

If I remain beyond my scheduled reservation without authorization, I understand that I may be charged for the additional time at a rate of $50 per hour, subject to The Sim Box's current booking policies.

9. CANCELLATIONS & CHANGES

Reservations may be canceled or modified up to 3 hours before the scheduled reservation time without penalty, subject to The Sim Box's current cancellation policy.

Cancellations made less than four hours before the reservation and no-shows may be subject to the full reservation charge.

At The Sim Box's discretion, an account credit or equivalent future simulator time may be provided instead of a refund.

10. 24/7 ACCESS

Because The Sim Box may operate as an unattended or 24/7 indoor golf facility, I understand that I am responsible for the access credentials provided with my reservation.

I agree not to share my access code, digital key, or other entry credentials with unauthorized individuals.

I will not allow individuals who are not part of my authorized reservation to enter the facility using my credentials.

Misuse of facility access may result in termination of current and future access privileges.

11. SECURITY CAMERAS

I understand that The Sim Box may use security cameras and recording systems throughout the facility for safety, security, property protection, access verification, and operational purposes, as permitted by applicable law.

I agree not to cover, disconnect, damage, move, disable, or otherwise interfere with security cameras, access controls, computers, simulator systems, or other security equipment.

12. ALCOHOL & CONDUCT

If alcohol is permitted at the applicable The Sim Box location, I agree to comply with all applicable laws and facility policies.

Underage drinking, providing alcohol to minors, excessive intoxication, threatening behavior, fighting, dangerous conduct, or other disruptive behavior is prohibited.

The Sim Box reserves the right to terminate a reservation and require guests to leave when their behavior creates a safety concern or violates facility rules.

13. GOVERNING LAW

This Agreement shall be governed by and interpreted according to the laws of the State of Michigan.

Any dispute relating to this Agreement shall be handled in a court of competent jurisdiction as permitted by Michigan law.

14. SEVERABILITY

If any portion of this Agreement is determined to be invalid or unenforceable, the remaining provisions shall remain in effect to the fullest extent permitted by law.

15. Privacy Policy:

Sharing of Personal Information
Go Green Golf LLC DBA The Sim Box will not share, sell, or disclose your personal information or mobile opt-in data to third parties without your explicit consent, except where required by law. Your information is kept confidential and used solely for the purposes you have agreed to. All the above categories exclude text messaging originator opt-in data and consent; this information will not be shared with third parties. Text messaging opt-in data is not being shared with third parties.

Opting Out of Text Messages:
You have the right to opt out of receiving text messages from The Sim Box at any time. To opt-out, you can reply "STOP" to any text message you receive from us.

Consent and Opt-In:
By providing your phone number and opting in to receive text messages, you consent to the collection and use of your personal information as described in this policy. We ensure that your consent is obtained explicitly and that you are informed about the types of messages you will receive.

116. ACKNOWLEDGMENT

By signing or electronically accepting this Agreement, I acknowledge that:

I have had the opportunity to read the entire Agreement.

I understand the risks associated with indoor golf and golf simulator activities.

I understand that golf clubs and golf balls can cause serious injury or property damage if used improperly.

I voluntarily assume the risks associated with participating in activities at The Sim Box.

I agree to follow all safety rules and facility policies.

I understand that I may be financially responsible for damage caused by me or my guests.

ACCEPTANCE OF AGREEMENT

I ACKNOWLEDGE THAT INDOOR GOLF INVOLVES INHERENT RISKS, INCLUDING RISKS ASSOCIATED WITH SWINGING GOLF CLUBS, FLYING GOLF BALLS, SIMULATOR EQUIPMENT, OTHER PARTICIPANTS, AND PARTICIPATING IN GOLF ACTIVITIES WITHIN AN ENCLOSED AREA.

I HAVE CAREFULLY READ THIS AGREEMENT, UNDERSTAND ITS TERMS, AND VOLUNTARILY ACCEPT THE RISKS ASSOCIATED WITH USING THE SIM BOX FACILITIES.
